Expert Meeting regarding Regulatory Dispute Settlement held by the Hanns Seidel Foundation and the Ministry of Law and Human Rights

On 14th January 2019, representatives of the Litigation Directorate of the Directorate General of the Ministry of Law and Human Rights held a meeting with legal scholars and experts to discuss the dispute settlement mechanisms regarding conflicting regulations. This was followed on 15th January 2019, by an expert panel session in the Ministry of Law and Human Rights.

Background

Two types of dispute resolution mechanisms exist under Indonesian law: litigation and non-litigation. The dispute resolution mechanism through non-litigation (or alternative dispute resolution) is stipulated in Regulation No. 32 (2017). Hanns Seidel Foundation supports the establishment of the alternative dispute resolution mechanism.

 

Procedural Guidelines

The session was attended by representatives of the Litigation Directorate of Ministry of Law and Human Rights, interested parties, and Indonesian legal experts from different universities.

The overall goal of the expert meeting was to provide feedback regarding the implementation of the regulation (both by regional and the central government). It further aimed to establish legal certainty regarding the procedures and clarify issues which were not resolved so far.
