Development of AI liability regulations in Vietnam
Workshop on International Experiences on Regulatory Approaches for Artificial Intelligence (AI) Liability

Building on the initial results of a workshop, the HSF Vietnam, in collaboration with the Ministry of Justice of Vietnam, organized a follow-up workshop on the legal stakeholder responsibilities related to artificial intelligence (AI). This workshop is part of a three-year cooperation program on the Rule of Law Dialogue between Vietnam and Germany.

The previous workshop between HSF and MOJ laid the groundwork by highlighting the current state of AI and relevant regulations in Europe, and initiated discussions among legal experts and policymakers on the complexities of civil and criminal AI liability, with case studies on social bots and autonomous vehicles. As AI technologies continue to advance and integrate into various sectors, the need for a robust and adaptive legal framework has become even more pressing. This follow-up workshop aims to further discuss the concepts discussed in 2023, focusing on practical case studies and implementation strategies related to the AI Act, AI Liability Directive, and other relevant international AI regulations. Ethical considerations in developing AI legal frameworks will also be discussed. The workshop brought together an international and national cohort of experts, including those who participated in the previous session, to build on the established foundation and address new challenges that have emerged over the past year.

In their opening remarks, Mr. Trần Tiến Dũng, Deputy Minister of the Ministry of Justice, and Dr. Susanne Luther, Director of the Institute for International Cooperation at HSF, emphasized the importance of knowledge exchange on AI regulations between the EU, Germany, and Vietnam. The Deputy Minister expressed optimism that the insights from the workshop would significantly contribute to the implementation of Decision 127/QĐ-TTg by the Prime Minister on AI development. International input was presented by Prof. Dr. Eric Hilgendorf from the University of Würzburg. Prof Hilgendorf shared with the audience the process in approving the AI Act from the European Commission and how the Act will be implemented in EU countries. Additionally, Professor Hilgendorf also shared information about the draft on legal liability of non-contractual cases related to AI with the aim to modernize the overall AI liability Directive. After the sessions of Prof. Hilgendorf, Assoc Prof Dr Mike Perkins from the British University in Vietnam spoke about a different angle of AI: ethical considerations. According to Dr Perkins, AI ethics affect many aspects of life such as society, law, political competition and commercial competition. In Vietnamese reality, this process requires the coordination of engineers, scientists and management agencies such as the Ministry of Science and Technology, the Ministry of Information and Communications, Ministry of Justice and the Ministry of Public Security.

In the 2nd day of the workshop, national experts, including Prof. Ho Tu Bao, Head of Data Science Department of the Mathematic Advance Institute, Mrs Le Thi Van Anh, Deputy Director General of Criminal Law Department , MOJ, Lawyer Nguyen Tuan Linh of Baker & Mckenzie Law firm, and Mrs Chu Hong Trang, representative of Ministry of Information and Communications presented their research on the needs for improvement of the current legal framework in order to utilize the benefits of AI in the Vietnamese society. Participants also discussed the status quo of AI related regulations in Vietnam, including the upcoming Data Law drafted by Ministry of Public Security, the National Strategy on AI to 2030 of the Prime Minister’s Office, or principles on AI research from the Ministry of Science and Technology.
